Offline Registration-
Hindu Marriage Act
The Act applies to persons covered by its provisions, including Hindus, Buddhists, Jains and Sikhs, subject to the statutory exceptions. A marriage must meet the applicable conditions and be solemnised through the requisite customary rites and ceremonies. Registration under section 8 facilitates proof; it is not a substitute for solemnisation.
Special Marriage Act
The civil-marriage route can be used by eligible parties, including couples of different religions, subject to the Act. For a proposed marriage, section 5 requires at least one party to have resided in the Marriage Officer’s district for at least 30 days immediately before notice. The Act provides a 30-day objection period after publication of notice; objections and appointments may affect completion.
Registration of a marriage already celebrated in another form under Chapter III is a separate route. Both parties must have completed 21 years and have resided in the district for at least 30 days immediately before the application, alongside the other section 15 conditions. Section 16 provides a 30-day objection period. A fixed one-day or 60-day completion date cannot be promised.
