Bombay High Court: family law and related proceedings

A guide to enquiries involving family-law appeals, applicable Original Side matters and related High Court proceedings across Maharashtra and Goa. Identify the order, the correct proceeding and the appropriate seat or bench before deciding the next step.

Start with the correct forum

An ordinary divorce, maintenance or custody matter first requires identification of the governing law and competent Family Court or other statutory court. The Bombay High Court’s Original Side is not a general substitute for that filing route. If a case or order already exists, its court, legal basis and procedural stage help determine whether a High Court remedy is available.

Appellate and supervisory proceedings

Family Court appeals and other challenges require an assessment of the particular judgment or order. Section 19 of the Family Courts Act provides an appeal route for qualifying judgments and non-interlocutory orders, while excluding consent decrees or orders and the maintenance orders specified in that section from that appeal route. Revision and supervisory remedies require a separate assessment. Have the order and relevant dates reviewed promptly for maintainability and limitation.

Original Side and special jurisdiction

Original Side and special jurisdiction matters require their own legal and territorial assessment. The court’s Original Side Rules include special procedures such as those for the Parsi Chief Matrimonial Court and testamentary or intestate matters. A family connection to a dispute does not, by itself, establish Original Side jurisdiction.

Related proceedings and urgent issues

A family dispute may also involve criminal proceedings, protection or maintenance orders, transfer issues, or an urgent application. Each proposed High Court proceeding needs its own assessment of the applicable law, available remedy and procedural conditions. A matrimonial settlement does not automatically terminate every connected case, and an urgent enquiry does not establish entitlement to a stay or a particular listing date.

Seats and benches

The relevant seat or bench depends on territorial jurisdiction, the case type, applicable rules and current court directions. The Chief Justice may direct a matter to another seat or bench in accordance with the rules. The locations listed here describe the court; they do not represent platform offices or confirmed professional availability.

Mumbai principal seat

The principal seat includes the court’s Original and Appellate Sides. The correct side and filing route must be identified for the matter.

Nagpur Bench

The applicable territorial allocation and current court directions determine which matters are presented at Nagpur.

Aurangabad Bench

The applicable territorial allocation and current court directions determine which matters are presented at Aurangabad.

High Court of Bombay at Goa

Matters arising in Goa require assessment of the applicable governing law, court order and High Court filing route.

Kolhapur Circuit Bench

The amended Appellate Side Rules expressly provide for the Circuit Bench at Kolhapur. Use the current rules and court directions when identifying the filing location.

Prepare your enquiry

  • Name of the court, case number and type of proceeding.
  • Date and copy of the order or judgment to be reviewed, where available.
  • District, brief chronology and any upcoming hearing or compliance date.
  • Existing applications, connected cases and the specific relief being considered.
